1  delaware and your privacy

In this Privacy Statement, you will find more information about the processing of your Personal Data by delaware.

Delaware Consulting CV (“delaware”, “we” of “us”) considers your privacy as very important. We strive to process your Personal Data in a lawful, appropriate and transparent manner in accordance with the General Data Protection Regulation (EU) 2016/679 (the "GDPR") and any national legislation adopted pursuant to the GDPR. With this Privacy Statement, we want to emphasise this commitment.

2  What is the scope of this Privacy Statement and for whom is it intended?

delaware is a company incorporated under Belgian law, with registered office at Kapelter Bede 86 in 8500 Kortrijk, Belgium, registered with the Belgian Crossroads Bank for Enterprises under business number 0479.117.543.

In all situations described in this Privacy Statement, delaware will process your Personal Data as a controller. This means that we determine the purposes and means of processing this Personal Data; in other words, we determine its 'how' and 'why'.

This Privacy Statement is intended for all visitors to the delaware website, all (potential) applicants and all (potential) service providers and customers of delaware.  

For the purpose of this Privacy Statement, a Delaware Affiliate means any other entity that controls, is controlled by, or is under common control with delaware. For the purposes of this definition, "control" means the power, direct or indirect, to manage the affairs of an entity by virtue of participating in a shareholding of at least 40 per cent of the voting rights, participating interests or economic interests in that entity.

Such processing shall be carried out either in accordance with what is described in this Privacy Statement or, where applicable, in accordance with a separate Privacy Statement made available on the sub-domain of the Delaware Affiliate in question. 

For the purposes of this Privacy Statement, the term Data Protection Law means Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data ("GDPR"), as well as any other legislation and/or regulations introduced on the basis of the GDPR and the e-Privacy Law, or which implements, modifies, replaces or consolidates it or any of these, and any other applicable legislation relating to the processing of Personal Data and privacy.

Personal data refers to any information regarding an identified or identifiable natural person. This includes, for example, your name, photograph, telephone number, email address, bank account number etc.

Processing means an operation or set of operations relating to (a set of) Personal Data, whether or not performed by automated means, such as collecting, recording, organising, structuring, storing, updating or amending, retrieving, consulting, using, disclosing by transmission, disseminating or otherwise making available, aligning or combining, blocking, erasing or destroying data.


3  When and why do we process your Personal Data?

3.1. When you visit the website

When you visit the delaware website, we collect a limited amount of Personal Data necessary for the management and operation of the website. With your consent, we also collect other Personal Data, for example to optimise the user experience on our website or for analytical and statistical purposes.

From time to time, delaware organises physical and virtual events, such as physical seminars or study days and online webinars, for which you can register either through a dedicated form on the website. by sending an email to events@delaware.pro or using any other registration method. As part of this, we process your Personal Data for the purpose of organising and managing the event and to be able to communicate further necessary information to you.

3.7 When you apply for a job at delaware

When you submit an application to delaware, for example via the delaware website or a third party website, such as LinkedIn, for a position at delaware, your Personal Data will be processed for recruitment purposes and for the administration and management of our (future) employees. 

However, if your application is unsuccessful (for example if the position has already been filled), your Personal Data will be stored by delaware for a period of twelve months thereafter. After the expiry of this period, you will receive an email asking you to choose whether you want to keep your Personal Data in the system for a longer period or have your Personal Data removed from the system. If you do not respond within 30 days, your data will automatically be anonymised in our database. This process repeats itself every year as long as you decide to stay in our database.

If your application is successful, you will receive another privacy statement.


3.7.1 Recruitment purposes

In the context of recruitment, delaware processes your Personal Data for the following recruitment purposes: recruitment, administration and management of (future) employees.

4  How is your Personal Data shared with third parties?

We only share and disclose information, including to third parties, as described in this Privacy Statement.

Your Personal Data will also be shared with governmental bodies and/or police officials when this is necessary for the purposes described above, where required by law or where necessary for the legal protection of the Controller's legitimate interests in accordance with applicable law.


5  Is your Personal Data transferred outside the EEA?

For the purposes described in this Privacy Statement, your data will generally be held within the European Economic Area ("EEA") and will only be transferred outside the EEA to a country or countries that the European Commission has recognised as providing an adequate level of data protection. If your data are transferred to, or stored in, a country outside the EEA that is not recognised as providing an adequate level of protection, delaware will take appropriate security measures to ensure that the transfer meets the requirements of the Data Protection Act.

6  How long will we keep your Personal Data?

We will retain your Personal Data for as long as necessary for the performance of the processing activities listed in this Privacy Statement, as long as you are otherwise informed or as long as permitted by applicable law.


7  What are your rights and how can you exercise them?

When delaware processes your Personal Data, the Data Protection Act grants you various rights. Barring legal exceptions, you can exercise them free of charge. These rights may be limited, for example, when complying with a request would reveal Personal Data about another person, or when you ask us to delete information we are legally obliged to retain or that we retain based on our legitimate interests. If you contact us to exercise your rights, we will respond within one month. Exceptionally, this may take longer (up to a maximum of three months in total), but we will let you know within one month. Whether or not you can exercise your rights depends on the processing and the legal basis.

We ask you to ensure that it is always clear exactly which right you wish to exercise and by what means (e.g. email, post, oral etc.) you wish to receive the information. Please note that in some cases we may need more information. We want to be sure that we are helping the right person.

Should you have any unanswered concerns, you always have the right to complain to the supervisory authority. We naturally encourage you to come to us in the first instance but, to the extent that this right applies to you, you are entitled to complain directly to the supervisory authority.


7.1 Right to access and correct your Personal Data

You have the right to access, review and rectify your Personal Data. You may be entitled to ask us for a copy of your information in order to appraise and/or change it. If you wish to correct information such as your name, email address, address and/or any other data or preferences, you can easily do so by contacting us at privacy@delaware.pro. You can also ask us for a copy of the Personal Data we process as described in this Privacy Statement.


7.2 Right to object

You may object to the processing of your Personal Data under certain circumstances described in the Data Protection Act, including when your Personal Data is processed for direct marketing purposes, as well for any potential reasons related to your specific situation when delaware processes your Personal Data based on the legitimate interests of delaware or a third party. 


7.3 Right to withdraw your consent

Wherever we rely on your consent, you will be able to choose at any time and on your own initiative to withdraw such consent by contacting us at privacy@delaware.pro. The withdrawal of your consent shall not affect the lawfulness of the processing based on your consent before any such withdrawal.


7.4 Right to restrict processing

Under certain circumstances, and as described in the Data Protection Act, you may request us to restrict the processing of your Personal Data. This is the case, for example, if you are disputing the accuracy of your Personal Data. If so, we will restrict the processing until we are able to verify the accuracy of your data.


7.5 Right of deletion

In accordance with the Data Protection Act, you have the right to delete your Personal Data as processed by us, as described in this Privacy Statement, in the event that it is no longer necessary for the purposes for which the data was initially collected or processed, or in the event that you have withdrawn your consent or objected to a type of processing described in this Privacy Statement and no other grounds for processing exist. If you want your Personal Data to be deleted, you may submit a request via privacy@delaware.pro


7.6 Right to Transferability of Personal Data

Where the processing of your Personal Data is carried out through automated processes and is based on your consent or on the performance of a contract between you and us, you have the right to receive the Personal Data processed about you in a structured, commonly usable and machine-readable form and to transfer it to another service provider.


8  Does this Privacy Statement apply to third party websites?

When you click on a link from a third-party website, you will be directed to a website over which we have no control and our Privacy Statement will no longer apply. Your browsing behaviour and interaction on any other website is subject to the terms of use and privacy and any other statements applied by the third-party websites. We recommend that you read the privacy statements of other websites carefully. Delaware is not responsible or liable for the information or content presented on third-party websites.


9  What happens if delaware changes this Privacy Statement?

Delaware reserves the right to modify and update this Privacy Statement as needed. If this involves a fundamental change to the processing or if the changes are relevant to the nature of the processing or affect you and your data protection rights, we will draw your attention to this.
